Do I own the apartment outright?
Ownership structureNo. As a foreign buyer, you acquire exclusive long-term usage rights to a specific apartment, registered with a local notary. The underlying land is held under SHM (Sertipikat Hak Milik - Indonesian freehold) by a local landowner. PT MyResorts Ananta Two holds a registered 30+30 year lease over plot SHM 4907 / Desa Canggu (1,400 m²).
How long do my rights last?
Term & extension30 years initial term + 30-year extension option (60 years total potential). Extension priced at prevailing market rate; if no agreement, median of six independent Bali appraisal firms (three per side) determines the price.
Can I leave it to my heirs?
SuccessionYes. All rights and obligations under the contract pass in full to your legal successors. Indonesian (Balinese) law governs the underlying contracts, except for guarantor obligations governed by Czech law.
What ROI can I realistically expect?
Return projections9-13 % p.a. depending on floor and occupancy, with indicative payback in 7.7-11.1 years. Based on ADR USD 140-215, occupancy 70 %, 256 nights/year, subject to operating expenses. Projections, not guaranteed.
How is my profit share calculated?
Profit calculationPartner share = monthly resort turnover × your unit coefficient, less 20 % management fee, operating costs, taxes and reserves pro rata. Coefficients fixed in your operating contract - Type A/B = 2.68 %, Type C = 2.98 %.
Can I use the apartment myself?
Owner useYes - 14 nights per year free of charge outside peak season, bookable at least 60 days in advance. During own use you pay only actual operating costs. Peak-season own use at owner rate (−30 % off ADR). Family use included.
When and how often am I paid?
DistributionsMonthly. The operator delivers a reporting pack by the 20th of the following month (occupancy, costs, fee breakdown, profit calculation) and pays the profit share by the same date. Plus on-demand right to inspect underlying accounting.
What currency? Any FX risk?
Currency & FXAll payments denominated in USD. No IDR exposure for the buyer. The developer absorbs USD→IDR conversion risk for Indonesian construction costs. Buyers paying from CZK/EUR accounts bear their bank's standard conversion on each instalment, but the binding amount is always USD.
What if construction is delayed?
Construction riskYou may withdraw if shell completion is more than 12 months late, full completion more than 12 months late, or the developer fails to sign the transfer deed within 90 days of valid call notice. USD price locked at SPA - no escalation for construction cost overruns.
Can I resell? Can I exit the operator?
Resale & exitYes - usage rights transferable with operator's prior written consent (cannot be unreasonably withheld); new buyer inherits all rights and obligations. Operating contract terminable with 1-year notice, no minimum lock-up - your unit leaves the rental pool but usage rights remain.
